The UBA encouraged the CUBA club to leave its headquarters in Núñez in ten days
The club occupies land that historically belonged to the University, and was restored to it by the Navy in 2018. In addition to CUBA, there are two other clubs that should pay, between the three, about 14 million pesos per month to remain on the land.
The Superior Council of the University of Buenos Aires ( UBA ) ordered last Wednesday the University Club of Buenos Aires ( CUBA ) to vacate its headquarters in Núñez (Avenida Cantilo 3215) in ten days. The conflict between the entities, which promises to go to court, has been going on for more than 50 years. The lands claimed by the UBA are also occupied by the Naval Center and the Naval High School , and, according to the University, they are for the public good. To stay in place, clubs would have to pay a total of 14 million pesos per month to the UBA, but since its inception they have not paid and have remained on the land through precarious permits.
Before the intimation, CUBA expressed in a statement that "it would have preferred to find a consensual solution" but that, given the shortness of the deadlines, they will immediately exercise the available judicial remedies with the aim of preventing "the unreasonable and unjustified measure taken ."
According to the UBA authorities, an attempt was made to negotiate with all the clubs involved in the dispute, but it was not possible to move forward. In the case of CUBA, he indicated that they only tried to "delay the matter."
“During the last meeting we had, in December 2019, we told them that they could not continue to be there for free because it is a public space. For us, today, they are ABC1 squatters . The conflict between the CUBA club and the UBA
The dispute over these lands dates back to 1958, when then-President Arturo Frondizi transferred the lands to the UBA by decree. Three years later, a sanctioned law confirmed the transfer.
In the place, the Argentine Navy had a dock whose use was authorized by law. The UBA had to build a new dock , in another place, for the Navy to withdraw from there. This did not happen and the Navy granted a precarious use permit to these clubs so that they could use those lands.
As it was a precarious permit, the clubs could use the property, but it was clear that the authorization could expire at any time and, although they could carry out activities, these lands were never owned by the clubs.
After years of dispute, in 2018 the UBA signed an agreement with the Navy to restore the lands, in exchange for a commitment by the University to build the dock and to grant the use of 20 moorings and some sheds for the training of your personal.
In May of last year, the Argentine Navy restored to the UBA an extensive land bordering the Río de la Plata: some 24 hectares that are behind Ciudad Universitaria and that extend from the property of the Federal Police Circle -and the Mouth to the Río de la Plata of the Medrano stream- to the vicinity of Cantilo Avenue. This agreement triggered the conflict with CUBA, Liceo Naval and Centro Naval.
The General Secretary of the UBA told the newspaper Infobae, we did not have a good reception , especially from the Naval High School and that is why we began the procedures for them to vacate the land. In the case of CUBA, the Superior Council ordered the vacating of the property and they were notified. The Naval Center is also in the process of receiving the notice.
CUBA Nunez
The Núñez de CUBA headquarters, located on Avenida Cantilo 3215, was inaugurated on September 19, 1959, and the works on the premises offer the possibility of practicing yachting and windsurfing, rugby, tennis, soccer, volleyball . The club has two restaurants, six tennis courts, two for rugby, one for soccer, swimming pool, 290 moorings and more than 100 boats in the beach.
Since its creation, the club assures that it has made numerous investments in the lands that belong to the UBA . The first works consisted of raising the level of just 3 feet above 0 in many parts and taking it to 5 meters above. The property was planted; defenses were made; electric cables were laid from 600 meters; moorings were placed; a first square was built replaced by a larger one; the access road was improved and the access channel to the bay was dredged, they exemplify.
After appraising the properties of the clubs at Banco Ciudad, the University of Buenos Aires explained that CUBA should pay it 6 and a half million pesos per month, the Liceo Naval 4 million and the Naval Center 2 million.
Genovesi concluded, there is a rental value that arises from market values. We are civil servants, we do not assess, if they cannot pay it, they will have to leave.
