In a letter sent to the Supreme Court by the regional prosecutor, Xavier Armendáriz, indicated that "information can be returned", if the minister requests it.
The regional prosecutor, Xavier Armendáriz , wrote to the Supreme Court discrediting the defense of Minister Enrique Paris about his refusal to deliver the emails in the framework of the investigation for the alleged crimes of reckless dissemination of pathogens; homicide and falsification of public document, amid the coronavirus pandemic.
In his letter, Armendáriz pointed out that the Minister of Health "in his report did not even make an outline of opposition regarding the background information that is of interest to this investigation ."
For the prosecutor in charge of the case, in case Paris does not want to hand over the information because there is other information that may be "not pertinent to the cause under investigation", it can be returned.
Of course, the prosecution acknowledged that "the only controversy in the procedure is to determine whether compliance with the judicial order for the delivery of information effectively and concretely affects national security ," one of the main arguments that the executive has advanced.
